1. General

These Terms and Conditions (hereinafter referred to as "T&Cs") govern the business and contractual relationships, as well as the resulting services, between Becausewelovek.com (hereinafter referred to as "Becausewelovek") and the customer.

Any deviations from these agreements require the express written consent of Becausewelovek, including any waiver of the requirement for written form.

2. Conclusion of Contract

The offers on the online store of Becausewelovek are non-binding and not to be understood as firm offers. A contract between Becausewelovek and the customer is only concluded upon acceptance of a customer order by Becausewelovek via order confirmation email or through the delivery of the ordered goods. If there are delivery difficulties on the part of our manufacturers/suppliers or insufficient creditworthiness of the customer, Becausewelovek may cancel the contract without liability.

3. Products and Information

All information, photos, technical specifications, etc., regarding our products are provided without warranty due to possible changes. Technical modifications, printing errors, and mistakes are reserved.

4. Prices and Costs

All prices from Becausewelovek are stated in Swiss Francs (CHF) and include value-added tax (VAT). Additional costs (e.g., shipping and packaging costs, surcharges for the chosen payment method) are displayed separately at the time of order and are added to the total price. The price applicable is the one valid at the time of ordering. Subsequent price fluctuations during order execution will not be considered. Errors are reserved.

5. Intellectual Property

Becausewelovek reserves all copyrights and other property rights. Copying or otherwise reproducing the entire website of Becausewelovek or individual components for commercial or inappropriate purposes is prohibited. All images, texts, detailed data, logos, brand names, product names, and company names on the Becausewelovek website are the property of Becausewelovek or authorized third parties.

6. Payment Methods, Terms, and Retention of Ownership

Becausewelovek accepts payment methods such as prepayment, credit cards, and PayPal and may impose surcharges on certain payment methods. Without prior notice, Becausewelovek may approve additional payment methods. Payment data submitted online by the customer to Becausewelovek is encrypted for security reasons.

For prepayment purchases, invoices must be paid within 10 calendar days as per the details in the order confirmation, failing which Becausewelovek may cancel the order. Payment for delivered goods by invoice (not prepayment) must be made within 30 calendar days.

Becausewelovek reserves the right to conduct credit checks on customers and may forward customer data to third parties for this purpose. Certain payment methods may be excluded for specific customers without explanation.

Products remain the property of Becausewelovek until full payment (including all surcharges) is made, and ownership may be registered accordingly. In case of payment default, a 5% annual default interest and a minimum debt collection fee of CHF 50 will be charged.

7. Ordering

Becausewelovek can only process orders from Switzerland, and orders are only accepted through the online store. Orders placed orally, by phone, email, or postal mail cannot be processed. Orders from minors or individuals under guardianship are only allowed with the consent of a legal representative. Usually, an order confirmation is sent via email after order completion.

8. Delivery and Partial Deliveries

Ordered goods cannot be picked up and are exclusively shipped by mail within Switzerland. Partial deliveries are permitted. If a package cannot be delivered by the postal service, it will be stored at the respective post office for 7 days. If the package is not collected on time, it will be returned to Becausewelovek, which may resend the package. The resulting additional shipping costs will be borne by the customer.

Delivery times provided by Becausewelovek are estimates and not binding. If delivery deadlines cannot be met, the customer may withdraw from the order after submitting a written extension of at least 60 days. No further claims can be made by the customer.

9. Transport Risk and Damage

Products are insured for transport to a limited extent and otherwise shipped at the customer's risk. The customer must inspect the delivered goods immediately for accuracy, condition, and completeness and report any transport damage to the shipping company as soon as possible, but no later than 7 days after delivery.

In case of complaints, all parts of the original packaging must be kept and may only be disposed of with written consent from the shipping company or Becausewelovek.

10. Returns and Exchanges

Orders from Becausewelovek are binding, and there is generally no right to return or exchange. Exceptions may be made for the return of intact goods. Such returns require written approval from Becausewelovek. The customer will receive instructions on the return process and must comply with these guidelines. Returns of unused goods must include the sales receipt, be in the original packaging, and be sent at the customer's cost and risk. Unsolicited, incomplete, or incorrectly addressed returns will be returned to the customer. An administrative fee may be charged for improperly returned products.

11. Warranty and Replacement

Becausewelovek will replace defective or incorrect goods unless the defect is due to normal wear and tear or improper use. For manufacturing defects or incorrect deliveries, the customer must notify Becausewelovek in writing within 7 days of receiving the goods, or the delivery will be considered accepted. Hidden defects discovered later must be reported promptly. The warranty period is 12 months from the date of delivery. If a replacement delivery is not possible or fails twice, the customer will be refunded the purchase price upon return of the goods. Other warranty claims, particularly cancellation or reduction, are excluded.

12. Data Protection

Personal data provided when using the Becausewelovek online store is treated confidentially. Payment details are transmitted exclusively in encrypted form. By using the Becausewelovek online store and providing their data, customers consent to the necessary business use of their data. No further personal data analysis is conducted.

To improve our offerings, we collect tracking data about user browsing behavior. This data, collected via tools like Google Analytics, does not allow conclusions about individual users.

Becausewelovek does not send unsolicited emails (spam). If you receive unsolicited emails appearing to come from Becausewelovek, report them so they can be addressed promptly.

13. Liability Disclaimer

Liability beyond the warranty is excluded to the extent permitted by law, particularly for auxiliary persons, consequential damages, lost profits, and other indirect damages.

14. Final Provisions and Jurisdiction

The invalidity of individual provisions in the contract, including these T&Cs, does not affect the validity of the remaining provisions. Becausewelovek reserves the right to amend the T&Cs at any time.

The contract between Becausewelovek and the customer, including these T&Cs, is governed exclusively by Swiss law (Swiss Code of Obligations), excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Unless otherwise required by mandatory law, the place of jurisdiction for disputes is Zug.
